L'article plaide en faveur d'un usage controle et reflexif de la notion de discrimination, pleinement attentif a ce que l'usage de cette categorie fortement marquee par le droit fait a l'analyse sociologique des rapports de pouvoir et des inegalites sociales. Apres un retour sur le cadre juridique de la discrimination, il presente les appropriations qui ont ete faites de cette notion en sociologie, des deux cotes de l'Atlantique. Ces questionnements theoriques eclairent, ensuite, la presentation des principaux axes problematiques qui traversent la litterature americaine et française en sociologie du droit de la non-discrimination. **Discrimination: From a Legal Qualification To a Sociological Tool ** This article provides a theoretical reflection on the sociological uses of the category of discrimination, paying close attention to its relationship with the law. The article promotes a cautious and reflexive approach to the notion of discrimination, fully weighing the consequences of what a category so heavily marked by law does to the sociological analysis of power relations and social inequality. After examining the legal framework of discrimination, the article presents sociological appropriations of the notion, more specifically in the US and in France. These theoretical reflections, in turn, illuminate the presentation of the sociological literature on anti-discrimination law on both sides of the Atlantic.
